Designated Public Places Orders

The Criminal Justice and Police Act 2001 enables local authorities to designate any public place in their area if they are satisfied that nuisance or annoyance to members of the public has taken place which is associated with the consumption of alcohol in that place.

What does this mean?

Drinking alcohol in the area affected by a Designated Public Places Order (DPPO) is not always be prohibited, but the police now have powers to request that drinkers stop drinking and to confiscate any alcoholin their possession. Anyone who does not comply with these instructions would then be guilty of an offence for which they could be arrested and face a maximum penalty of £500.

Wyre Borough Council Designated Public Places Order (No 1) 2008

At a special Council meeting on the 19 May 2008 it was agreed that three areas in the Borough will become Designated Public Places. The areas affected by the Wyre Borough Council Designated Public Places Order (No 1) 2008 include Pharoes Ward, the area in and around Memorial Park, the Flakefleet area and the West View district of Fleetwood. Also included is an area of Cleveleys incorporating the town centre and jubilee Gardens and the town centre of Poulton.

These area are shown on the maps below

The following places are excluded from the Designated Public Place Order:

  1. Premises where a Premises Licence or Club Premises Certificate is in force to serve alcohol under the Licensing Act 2003 and places within the cartilage of these premises.
  2. On premises where the Council holds a Premises Licence or the Premises Licence is held on behalf of the Council which authorises the sale or supply of alcohol the order will not apply only at times when alcohol is being served under the licence and 30 minutes thereafter. This exemption applies to the Marine Hall, The Esplanade, Fleetwood.
  3. On premises subject to a Temporary Event Notice under the Licensing Act 2003 the order will not apply only at times when alcohol is being served under the licence and 30 minutes thereafter.
  4. Places where the sale or consumption of alcohol is permitted on public highways under s115E of the Highways Act 1980.

The effect of the Order is to make it an offence for any person to drink alcohol within the areas designated after being required by a Constable or Community Support Officer not to do so. The Order provides powers for the police to confiscate and dispose of any alcohol (and container for alcohol) in any person's possession in such a manner as the police consider appropriate. A person who fails without reasonable excuse to comply with a requirement made commits an offence and is liable to a penalty notice (£40) or on summary conviction to a fine not exceeding level 2 on the standard scale (£500.00)

The Order is to come into effect on the 11th July 08,
